Terms of service

Effective 2026-10-22 · Version 1

Status: draft, not reviewed by a lawyer.

  1. Agreement and acceptance - These terms are an agreement between you and AI Eh-B'y, a Canadian company that operates Shop Top Shelf ("the service", "we", "us"): the website shoptopshelf-sb.ai-eh-by.ca, the web app at app.shoptopshelf-sb.ai-eh-by.ca with its public shop pages and smart links, and the emails, text messages and notifications we send. By creating an account, you accept these terms, our Acceptable Use Policy and our Privacy Policy; the sign-in screen says so and we record the versions you accepted. You can browse public pages without an account.

  2. Who can use the service - You must be at least 14 years old to create an account. If you are under the age of majority where you live, you need the permission of a parent or guardian, including before you subscribe to a paid plan.

  3. The service - Shop Top Shelf is a storefront and marketing toolkit for associates of direct-sales (multi-level marketing) companies, and a place for customers to discover, follow and review them. Associates create a shop, list the products they sell with their own buy links, create content with AI tools, run campaigns with tracked links, and see their statistics. Customers browse shops, follow associates, like products, keep wish lists, write reviews and message associates. Shop Top Shelf is not a store: we do not sell, ship or deliver products, we do not take part in sales between associates, their companies and customers, and we are not a party to those purchases. Shop Top Shelf is not affiliated with or endorsed by any direct-sales company unless the service says so.

  4. Accounts - You sign in with Google, with your email address and a password, or with Apple where it is offered. Accounts that use the same verified email address are linked. Each account is for one person, and one person has one account and at most one shop. Keep your sign-in secure; you are responsible for what happens under your account. Tell us right away at privacy@ai-eh-by.ca if you think someone else has used it.

  5. Your content - Shop profiles, products, photos, content, reviews, messages and anything else you add remain yours. You give us a non-exclusive, royalty-free, worldwide licence to host, copy, adapt (for example resize images), display and send that content as needed to run and promote the service (for example showing your public shop and reviews on discovery pages), for as long as it is in the service. You are responsible for your content and confirm that you have the right to share it, including photos and product descriptions taken from your company's materials. We may remove content that breaks these terms or the law.

  6. Acceptable use - You must follow our Acceptable Use Policy, which is part of these terms. In short: no income claims, no health or cure claims, no misleading offers, no spam, no fake or paid-for reviews without disclosure, no contacting people without consent, no harassment, no unlawful products or content, and no attempts to break, scrape or game the service.

  7. Features - These rules apply to the parts of the service you use:

    1. Associates and shops - You are an independent seller, not our employee, agent or partner, and not a representative of Shop Top Shelf. You are responsible for your shop, your prices and buy links, your product information, and following your direct-sales company's policies (including any rules on online shops, brand names, images and pricing) and the law, including consumer protection, advertising and tax rules. You must not suggest that your company or Shop Top Shelf endorses your shop unless it does. You must make the disclosures the law and the networks require when you promote products you earn from.
    2. Catalogue - Products in our shared catalogue are added by us, suggested by associates or drafted by AI from public posts, and may be incomplete or out of date. When you add a catalogue product to your shop, you are responsible for the price, link and details you show.
    3. Smart links and statistics - Smart links and QR codes send visitors to your shop or product and count visits and buy-link clicks. Statistics are estimates: they show clicks, not sales, and can differ from your company's reports.
    4. AI features - The AI shop setup, content studio and insights use AI models (Privacy Policy section 13.2). Output can be wrong, inappropriate or similar to output given to others; you must review it before you use it, and you are responsible for what you publish. Nothing from the AI is applied to your shop until you choose it. Daily limits depend on your plan.
    5. Social accounts and scheduling - If you connect Instagram, Facebook or TikTok, you authorize us to use the permissions you grant as the Privacy Policy describes. Your use of each network stays under its own terms. Automatic posting happens only where the network allows it; otherwise we remind you at the scheduled time with a share kit and you post yourself. We are not responsible for a network refusing, delaying or removing a post, or changing what its API allows.
    6. Contacts, email and text messages - You may add to your contact list, and message, only people who gave you the consent the law requires for that channel. When you import contacts you confirm each time that they gave you express consent, and you must be able to prove it. We send campaign messages for you, add the unsubscribe and identification details, and honour unsubscribes and STOP replies at once; you must not re-add anyone who unsubscribed. You are the sender of your campaigns and responsible for their content and for following anti-spam law (in Canada, CASL). We may limit, pause or stop sending when messages bounce, are reported or break these rules.
    7. Reviews - Reviews must be honest and based on your own experience with the associate or product. Do not review your own shop or products, a competitor's, or in exchange for anything unless you clearly say so. Associates may reply publicly and must not pressure customers to change reviews. We may hold reviews for moderation, and remove reviews that break these terms; we do not edit what you wrote.
    8. Messages - Messages between customers and associates are for questions about products and orders. Do not use them for spam, harassment or to move someone onto unwanted marketing. Messages may be screened and reviewed for moderation.
    9. Teams - A team leader (Team plan) can share templates, campaigns and content that members may copy. Content shared in a team stays the sharer's; members use copies under these terms. Team statistics include a member only if that member allows it.
    10. Plans, trials and billing - Customers use the service for free. Associates can use the Free plan or subscribe to Pro or Team; the features and prices of each plan are shown on the pricing page and in the app before you subscribe, in Canadian dollars, with taxes added where they apply. Pro has a 14-day free trial, once per person. If you gave a payment method when you started the trial, the paid plan starts when the trial ends unless you cancel before then (we remind you before it ends); otherwise you return to the Free plan. Paid plans renew automatically each month or year until you cancel. You can cancel at any time in Billing (Stripe's customer portal); cancelling stops the next renewal and you keep the plan until the end of the period you paid for. Payments are not refunded for partial periods unless the law requires it or we say otherwise. We may change prices for future periods after telling you at least 30 days in advance; you can cancel before the change applies. If a payment fails, paid features may stop until it is paid.
    11. The web app - You can install the web app on your phone or computer from your browser. Installing it does not change these terms.
  8. Availability and changes to the service - The service is provided "as is" and "as available". We may change, suspend or stop features. If we decide to close the service, we will give you reasonable notice so you can download your data, and refund any prepaid period that we do not provide.

  9. Disclaimers - To the extent the law allows, we give no warranties or conditions beyond those the law requires, including that the service will be uninterrupted or error-free, that statistics or AI output are accurate, or that the service will bring you sales. We do not check associates, their products, prices, claims or buy links, and we are not responsible for them, for direct-sales companies, or for social networks.

  10. Limitation of liability - To the extent the law allows, we are not liable for indirect, incidental, special or consequential losses, lost profits, lost sales or lost data, or for the products, services or acts of associates, direct-sales companies, other users, social networks or other third parties, and our total liability for all claims relating to the service is limited to the greater of the amount you paid us in the 12 months before the claim and 100 Canadian dollars. Nothing in these terms excludes or limits liability that cannot be excluded or limited by law, or your rights under consumer protection law, including the Quebec Consumer Protection Act.

  11. Termination and account deletion - You can stop at any time by deleting your account (Settings > Delete account in the web app, or the account deletion page at shoptopshelf-sb.ai-eh-by.ca/delete-account); deleting your account deletes your shop and cancels any subscription. We may hide content, suspend a shop or close an account that breaches these terms or the Acceptable Use Policy; where it is reasonable we tell you why and let you respond at privacy@ai-eh-by.ca. Suspended shops are hidden from public pages. The Privacy Policy and the account deletion page explain what happens to your data. Sections 5, 7.6, 9, 10 and 13 continue to apply after your account ends.

  12. Changes to these terms - We post every change here with a new version number and effective date. For a material change, we will tell you in the app or by email before it takes effect, and the app will ask you to accept the new version before you continue; if you do not agree, you can delete your account.

  13. Governing law and disputes - These terms are governed by the laws of the Province of Newfoundland and Labrador and the federal laws of Canada that apply, and disputes go to the courts of the Province of Newfoundland and Labrador. This does not remove any right you have under the consumer protection laws of the place where you live, including the right of Quebec consumers to the protection of the Quebec Consumer Protection Act and to go to the courts of Quebec.

  14. Language - These terms are available in English, French and Spanish, and each version has the same effect; the French version is provided in line with the Quebec Charter of the French Language.

  15. Contact - AI Eh-B'y, Newfoundland and Labrador, Canada, privacy@ai-eh-by.ca. Privacy questions: privacy@ai-eh-by.ca.
